Would a 17 year old sleeping with a 15 year old be charged the same as a 50 year old?

Would a 17 year old be charged for sleeping with a 15 year old? Or better yet, would a 16 year old be charged with statutory rape if they slept with a 15 year old? If so, is it the same charge as say a 50 year old person with a 15 year old person.

P.S. This isn't my situation. I'm just interested to know.

I thought there was a 2 year age leeway, so 17 and 15 is allowed, 14 and 16 is allowed.

I think it stops at like age 14 or so when it's completely illegal.

Fuck that, it's different for each state. For two, yes, 15 and 17 is legal. ACT and Tasmania give leeway.

No way it'll depend on the cop. Cops only investigate the case, but ultimately the Crown must prosecute for the protection of society, not just the victim. This isn't a question of discretion.

how about an 18 year old sleeping with a 16 year old? That's another possibility - only one of the age of consent but less than 2 years difference (obviously not my situation, but it would be interesting to know the answers, if there are any).

EDIT: my mistake. The above few posts weren't up when I posted so I didn't realise the age of consent for all states (so the topic Question and my question were one in the same).

Tasmanians are backwards anyway. According to the article, NSW doesn't give any leeway.

It is an offence in New South Wales to engage in sexual intercourse with a person under the age of 16 (Crimes Act 1900, s66C) or attempt such an offence (s66d). Further it is an offence to engage in sexual intercourse with a person under the age of 18 if that person is under the care of the offender (s73) (guardian, teacher etc).

So, that's pretty tough. Would a 50 year old who commits a lewd act with a minor be charged the same as a 16 year old who commits lewd acts with a minor?
