It is just me or was there no or seldom mention relating to the "50 year old" segment of the question?

Evidently, the law aims to maintain the triats of justice and equality, however, depending on the circumstances, individuals involved in the criminal justice system cannot be treated in EXACTLY the same manner.

A 17 year old and a 50 year old would not maintain the same frame of mind, the prosecution must determine the mental health of the accused at the time in question for one requirement and work from that.

So no they would not be treated the same. Although, general rules of precent obvioulsy apply.
