Hi guys,

I'm a little confused at the moment. We just got back our results for our half-yearly and I missed out on two marks because I listed the 'Jurisdiction Test' as one of the tests conducted by Legal Aid. Now, I've got different resources (Pearson's Legal Studies HSC, Excel HSC Legal Studies) all telling me it is a legitimate test, but my teacher stated it was not an actual test, and therefore gave me 2/4. Although only two marks, they currently (to my knowledge) stand between me and 3rd/4th rank.

Thanks,
Ben

Hey Ben,

You have every reason to be confused because Legal Aid does in fact stipulate a Jurisdiction test in its eligibility criteria. See http://www.legalaid.nsw.gov.au/get-...r-legal-aid/policy-easy-guide/legal-aid-tests

There are two elements to the jurisdiction test: 1) The offence occurred in NSW and was a state crime, 2) That it fulfilled the areas of law that Legal Aid covers. For example:

- offences which may incur a jail sentence
- family issues involving children
- matters that involve DoCs
- other issues such as discrimination and mental health. [http://www.legalaid.nsw.gov.au/get-legal-help/applying-for-legal-aid]

Good luck with getting those 2 marks
