Prostitution is a victemless crime, I'm not sure if that means it is illegal or not.

I dont think its illegal if the prostitute solicits you from private property, such as a prositute calling from her window to a person on the street if they want a good time But if the prostitute solicits you on the street, like most prostitutes then its illegal

yeh see i read that prostitution is a victimless crime, which is still a crime hence it's illegal... right? well hey its illegal in NSW i think. but then how can TheCross operate if prostitution is indeed illegal?

Not too sure on how far it's illegal. It is against the law to solicit, prostitution as a service wouldn't be as such. The laws governing the place of prostitution, would be under local government planning laws.

SEX INDUSTRY LAWS – New South Wales
First the good news - sex work is legal in NSW. Any person of any gender over 18 years old may provide sexual services to any person over the age of consent in exchange for money, goods or favours. Running, or working in a sex industry business in NSW is legal as long as it is conducted within the legislative framework.
Brothels are any premises used for the purposes of prostitution. This can include premises such as massage businesses, strip clubs etc. where sexual services are also provided.
Brothels are regulated by local councils
The definition of a brothel can include one worker working from their own home or premises
Prostitution is legal and by itself is no longer a reason to have a business closed
Support staff (receptionist/front of house, security, managers) can now be legally employed
No one can force or unduly influence another person to become a sex worker.
Sex work laws that remain unchanged are:
Support staff (friends, partners) for street workers can be charged with living off the earnings
Street workers can be charged with soliciting and working near or within view of certain places
Can a massage service advertise and provide a sexual service within the law? - No. It is an offence to advertise or use any premises that advertise as massage, sauna baths, steam baths, facilities for physical exercise, photo studios or services of a like nature, for the purpose of prostitution or soliciting. These laws are not always enforced by the police but are more likely subject to action by councils.
Is street sex work Legal? - Street sex work and soliciting is legal in NSW but only in certain areas. It is illegal to solicit within view of a residential dwelling , church, hospital or school. People can still be charged with living off the earnings of a street worker. Street sex workers can be fined for loitering by local council staff. Police can fine street sex workers for not following a reasonable direction.

It unfairly targets migrant workers and criminalizes them above and beyond all other laws regarding migration and the sex industry.

Its illegal in Australia that's why its an offence. (i'm pretty sure) and kingscross operates as a black market where most of the women are migrants or illegal immigrants who have been made false promises and then taken there and forced to do so........sad isnt it!

You think they would if it was illegal... we'd have drug dealers advertising their services if that was the cases. I got to Kings Cross all the time to club, the only thing I notice is the signs saying "Police targetting Curb Crawlers in this area"... i dunno what the hell that means, maybe to work as a prostitute you have to work under a licenced premises ie- a brothel and not directly on the streets. can someone clear that up?

What curb crawlers means is those people who drive along the streets calling out to the prostitutes and anyone else on the streets wanting sex or whatever elseSafiya said:
the prostitutes can work from the streets as long as they are not near residential housing areas, churches or schools but they are allowed to be on the streets thats why the main drag of Kings Cross is the place for it coz its not near a school or a church and the area they are in is not residential

The only way prostitution is made illegal is if you aren't working for a licensed brothel or you aren't licensed yourself as a sole owner (of the business). Licensing also requires you to obtain health insurance and the premises you work in could be randomly checked. This ensures the safety of both the escort and their client.
Ones you see t Kings Cross on the streets are, in the majority unlicensed. That's why police have regular undercovers working.
Child prostituion is illegal.
Brothels and prostitution will never ever be made illegal. They are the key drivers of the economy as a whole and well respected people in our society.
