for essays such as modern history and legal studies, you dont really have to use sophisticated language right? all you need to do is just have a clear and concise argument and answer the question right?

Pretty much as you said, you want to aim to argue your case as clearly and concisely as possible. Flowery language is for english and you'll probably never be expected to write like that again.

For legal studies, although the markers do kinda want you to use legal terms, it's best to use them appropriately and when needed. The point is the main idea that the marker is looking for.

You don't need to sound uber fancy or anything, but you are expected to refer to appropriate terms when necessary. Like in modern, you wouldn't just say 'they bombed the enemy to make them tired and sad' you would say something like 'They used constant bombardment to wear down the enemies morale'. So basically, you can write rather simply and too the point, making sure to use appropriate historical/legal words in their that give it more sophistication :)
