Legal Aid Commission Act 1979 (NSW)/Article 26 of the ICCPR: Legal aid is a subsided state provided service governed under the Legal Aid Commission 1979 NSW, assisting in the protection of individual rights under article 26 of the ICCPR, stating that individuals are granted ‘equal protection under the law’ through the provision of legal aid to those facing inequality.

Dietrich v Queen: Highlights the failure of self-representation in securing a just outcome, thus establishing a precedent that for a fair trial, the defendant must possess legal representation to secure a just outcome.

2014 Law Council Report/Article 14 of the ICCPR: Found legal aid is significantly limited in regards to accessibility and resource efficiency, as it “is substantially underfunded, with thousands of people going unrepresented.” This highlights that a lack of funds hinders an individual’s accessibility of legal aid, undermining article 14 of the ICCPR covering the right to a fair trial.

thank you so so so much, im using law reform in the sense of obviously amendments but when they create new legislation such as the legal aid commission act would you call that law reform as it is the introduction of new laws in accordance with the values (essentially) of society?
