in ear damages your hearing just as much, the sound is trapped inside your ear thats how it seems louder.

Um, no. Sound from any headphone will get 'trapped inside your ear', in ear means you can keep the sound lower because it blocks ambient noise.

i have permanent tinnitus too now i think, i went to my mates gig and i was standing right infront of his amp (i wasnt thinking T_T), its fucking annoying to get to sleep.
