If you say you were drunk but can recall it and you didn't break the window, but they have a few sober (who the hell?) patrons saying that you broke the window. You will lose.
They won't get patrons or staff saying I broke the window. Not a chance.

Yea but i don't think you can claim temporary insanity lol
If people in there varify that you didn't do it, you'll probably get off scott free (at least on that matter).

I think i saw you at customs last night bon. I was on the verandah and i saw someone that i usually see with a NES uniform talking to someone with a uniformed security dude on the verandah. I was there till about 1:30 i think and Didn't see any of the glass / window smashing . Good luck with the case though :)

Aha, yep that was me bud. Next time you see me come up and say g'day.

I smashed the glass up against the wall after it was closed, there was only bar staff and security around at the time..

Like I said before, I'd say it'll depend on the prosecution's evidence. That is, the security cameras. If they can't produce any such evidence or witnesses, I don't think there really is a case against you. You may be done for actually acting violently, but not for the heritage window. Maybe a good behavior bond or a monetary fine? I dunno. Just guessing?

They could, however, raise doubts as to whether you were sober enough to actually tell the difference between a brick wall and a window. You might like to ask the bar tender that served you how many drinks you actually had. :p

Cyph,

Just asked my father's friend (ex-Police Prosecutor), who says the only possible charge (as previously stated) is 'Maliciously destroying or damaging property'. He also says it would be bizarre if it got you more than a $500 fine, unless the damage was excessive.

Good luck with it!

Thanks, mate.

Is that for smashing the glass or the supposed window that was smashed?

I did hear him say "assuming he actually hit the window...", so if they can't prove you did you might be in luck.

Here's hoping, aye?

just got back from a meeting with my boss, apparently it was a window in the car park that got smashed..

They (Customs) are dirty and have called the cops.. obviously no one has seen me smash the window since I didn't do it so they have nothing. I've offered to pay damages to the wall from when I smashed the glass since I supposedly put a hole in it, hah. Could be up for malicious damage to property with the wall now I guess.
