what paras would u use for this?
U can use judicial discretion in CTP, community interest of holding offender accountable clashes with individual freedom of fair trial and taking into consideration mitigating factors. So community wants to see offender go to jail but offender wants the least jail time possible.

bail - tension between the offenders right to liberty but the community's need for safety - terrorist cases, definitely protect community, but with show cause like why was that negative, it reversed presumption of innocence

police powers - tension between keeping community safe from offenders but also don't hurt the offenders so much its very unnecessary, such as Curti case with tasers, did he really have to be tasered so many times?

you could only do these 2, but you could also do mandatory sentencing, like there's a tension between parliament making a law to have a guaranteed sentence for an offence, but that takes away judges discretion, and for the offender where is their rights if they were mentally ill and king hit someone yk? so that's a big tension
