Legal Studies Themes:

There are 6 themes that we have to know:

These are:
Justice, law and society, Continuity and change,Culture, values and ethics, Conflict and cooperation, Legal process and institutions and Effectiveness of the legal system

Justice, law and society:
the interrelationship between the concepts of justice, law and society


Continuity and change
the evolution of legal rules and institutions
the importance of precedent in establishing rules
the effects of social, political, economic and ideological factors and of community
attitudes
the means and processes by which the law changes



Culture, values and ethics
the extent to which law reflects the culture and values of different societies and
groups within society
the importance of ethics in the functioning of society



Legal process and institutions
how laws are made
the nature of legal institutions such as parliaments, courts, the United Nations
the adjudication and settlement of disputes and enforcement of legal rules



Conflict and cooperation
the nature and extent of conflict in society
the place of law in resolving conflict and encouraging cooperation


Effectiveness of the legal system
Effectiveness within the legal system has a number of meanings. They include:
the extent to which an issue can be dealt with by the law
if an issue is dealt with by the law, how well it is dealt with in terms of ease of
access, simplicity, consistency, predictability and delivery of just outcomes
the capacity of a law to stop or change human behaviour.



They can incorporate these themes into questions especially into extended responses so it is important for us to know these.

i have probs answering questions regarding this part of the syllabus; the relationship with justice, the law and the society.

any tips? (...crime, family consumers)

These themes are common to all topics I.e. crime, family consumers
You learn the concepts of justice, law and society in the law and society.HR topics
What is justice? what is fairness? what is equality?
How does the law respond to the issue... to promote justice for individuals and society.
That way, you can evaluate how effective the law is.

However, you need to remember if we indeed do get a question coming from the themes section of the syllabus, it would have to be applicable to ALL option topics.

Yeah the questions ARE usually common to all, just changing the words to consumers, or family, or workplace etc in the question and if they specify something, they say it in relation to that option.

You missed my point, I'm just saying that for a question to be asked it must be applicable to all options.

For example, it is unlikely that "The effects of social, political, economic and ideological factors and of community attitudes" will be asked because the World Order option lacks in this respect.

But they can say, "Examine the continuity and change that has occured in regards to World Order"

The legal themes can be asked for every topic. The dot points under each theme he has there aren't necessarily examples of questions, but ideas about the types of thing you would write about for that theme.

Without Wings, can you please sticky this thread until the end of the HSC so other students can see if unaware of the themes... (yeah some teachers don't really explain them much)
