I've read that article. I believe it was something like:
"If the game cannot be legally obtained in a store, then it is possible to download and play the ROM instead. If, however, there is a sale or product that comes out later, for example a 'Classic games collection' or similar. Then the ROMs will become illegal, since you can then obtain the game via legal means".
Otherwise, it is perfectly legal to play/run ROMs, if they cannot be obtained in a store, or if it is an "old" game (eg 1970, 1980 or similar, which you cannot play in the arcades, or purchase).
