As to OP's question about the chances of it happening, it depends on the text. Around 10 years ago a Bruce Dawe poem was used, he's hugely famous (only in Australia lol) and his poems are relatively simple and accessible. A lot of people would have been using that poem and it wouldn't take any marker aback if you had use it. They've also used really obscure poems though (less copyright issues) and in that case it is unlikely that a student had studied that text independently and any marker will realise that you've lifted the poem from section one. However, while they'll know what's happened, they won't deduct marks for that alone. And you can consider the last section one question as a draft essay that will help you refine your ideas too.
