I am just after confirmation that the information I have in relation to the Industrial Relations Act 1991 (NSW) and the NSWIRC is correct. Specifically, the last point.
I thought that industrial action is legal during the baragining period?Under the Act all enterprise agreememnts must be approved by the NSWIRC and be:
- agreed to by 65% of employees in a secret ballot
- Meet the no detriment test
- Contain dispute resolution procedures
- disallow industrial action during the bargaining period
