This is fucking rediculous.

The government should act in good faith and give ppple who are accused of crimes the benefit of the doubt.

im very sympathetic to the chick who got raped......like anyone who is touched by an immigrant i feeel sorry for you.

I would love to seee scum bag gang rapits killled..vigilante style. I saw a dude in nz...for many years he has been waiting for some low life to get out of jail to kill him for raping and i think killing his daughter ---- sick cunt.

But the government should take the higher moral ground.

You are innocent till proven guilty and should have the right to face ur accusers.

these alledged rapists etc, had a blotched trial because jurors fucked up---its not the allleged rapists fault.
The alledged rapists should have every right to have a full retrial.........................the government shoudlnt change the whole legal system just to apppease some chick...........................and win politcal points from feminists and other scummmy minority groups.

We have laws etc, to try and stop innocent ppple being sent to jail............and the government obviously doesnt give a fuck about that though........

Why dosen't the death penalty exist?

Anyway, to the topic - The victim is now no longer an accuser because it has been deemed in criminal trial beyond reasonable doubt that those guys gang raped her. I dont think she should have to relive the horror of that night. Im sure they pretty comprehensively covered it in the initial trial so transcripts of that should be enough.

the only reason they got 55 years was because of public outcry, and the Carr government wanting to win a few brownie points. They deserved it, but having the sentence for muder lower than rape is rather stupid.

But using the testimony from previous hearings when retrials occur on a technicality was a good idea. It isn't fair on the victims to be forced to get up and repeat their ordeal over and over and over because of scumbag lawyers who get arseholes off on technicalities.

It isn't like everyone that rapes gets 55 years, i believe rapes can sometimes be less than murder but other times be much more.

Yes, if you get caught for both you get sentanced for both. But it isn't rape unless the girl sais it is, and she is dead. Remember, beyond a reasonable doubt, even if there are wounds, you can say you like rough sex, or you were both sado-masochists, and with nobody to say otherwise the jury cannot convict you beyond reasonable doubt.


Nobody is questioning the sentance length by itself, but the sentance length in comparison to murder.

55 years for rape is pretty harsh, but like they said above, you'll get parole after a few years, and also, rape is a big issue and they probably want to make the sentencing harsh to prevent people from committing the crime.
but yeah, it's stupid how murderers can get away with less. it's really pissy how some previously convicted murderers are walking free today. they should pay more for taking a life.

I really question the rehabilitative value of prison for anyone. I think that all crimes where the criminal is not a risk to society should be punished with alternate methods. Thats more of a tangent to go on though discussion wise.

You don't need proof as such. You just need reasonable doubt.

But your point about people getting charged with rape when they murder is completely true. However, this is not every case, and nevertheless, in some cases a person WILL be able to get away with murder when it is a rape and murder case, and some may in fact choose to murder rather than rape due to the fact that rape can get you 55 years now.
