Genuine POW's are allowed to be detained without charges. Civilians have the right to a speedy trial.

no....well just shove them all in their and let them rot.......if u arrest someone based on suspicion then they deserve a trial.......geez ur tone would change if they chucked u in there based on suspicion for three years...

They're keeping him in jail and assessing wether he is a terrorists... in a sense they're judging him without representation, which is wrong, but it's ok if he is a terrorist.

Basically.. it takes time to determine if someone is a terrorist or not, so they have to hold people for a long time sometimes... the only other option is to simply detain no-one.

If they put me in gaol for 3 years on suspicion i would be pissed off, but you know what? the only other option is to detain NO ONE.

if they detain you on suspicion, they have to have a reason that they can back up, if not they should release you straight away, thats australian and american laws, but the smart asses are holding the detainees in a military camp in cuba where that law doesnt apply

It takes a long time to compile 'reasons' and figure out if they are plausable, it's not like some guy can just say " I saw him hanging with osama " and that's it...

then they shouldnt detain him in the first place uless they have PROPER suspicions, plus they caught habib in pakistan not afganistan so he wasnt fighting or shit and he was there even before the sept 11 attacks, so why and how would they suspect anything
plus have u seen the guy, hes turning 50 soon, whats he gonna do, fight?, he cant even run 200 metres
its just the stupid americans who are scared of everyone, so they detain everyone and after 3 years they just release them without any compensation or even an apology

It takes a long time before court cases go to trial in australia even, ie (a year or so), especially for things such as murder. That the americans can come to decisions about so many people, that are from so many countries around the world, having to do such in-depth investigations is amazing.

in any country people who are suspects are given a fair trial, no one in cuba got a fair trial, and while theyre in trial theyre innocent until proven guilty, and that means they are free until proven guilty then they are in jail, and even if they have proper suspicions why not hand him over to the australian govt?
because its bullshit

No, in australia sometimes bail is set othertimes people just have to stay in gaol untill their day in court..
America decided that they want to investigate further so they held him while they did their investigations, they came up with nothing after 3 years that was good enough to prove without reasonable doubt that he was a terrorist so they set him free.

3 years of his life, 3 years in jail, 3 years of torture, 3 years of no contact with any family, 3 years without a proper trial, 3 years deteriotation and then out of no where release him with no apology, seriously you have to admit somethings fucked up

They didn't trial them, however they considered the case and decided there wasn't enough evidence and it wasn't right for them to keep him.
It's not perfect, but it's the best they could do.

but seriously if u put urself in the detainees positions for a sec, i wouldnt blame them if they did become terrorists after getting released,
i remember my dad getting thrown in jail for three days because some lady said he touched her (lie her husband made up to get back at my dad cause they used to work together), and in court he went ballistic cause he didnt even know why they had had him in jail until he got released, and these detainees have been in jail being tortured for 3 years, thats just fucked

Yes it sucks that they went through that... but it wasn't really that bad, like i'm sure it's terrible... but they get cultural-specific meals, copies of the koran, games, they're allowed to mingle with other detainee's..

Like it sucks and could possibly be more accomidating, but the US is trying to get the job done and the job done fast... Guantanemo Bay without torture, with legal representation would require MUCH longer stays than 3 years.

"it wasnt that bad" come on man, its hell for anyone, you forgot to mention torture and cuffs and small dark rooms
and americans have no right to hold these men cause theyre not on american soil, so where ever they caught them, they should stay there and face their laws, if not send them to their own countries so they can take care of the trials, that would certainly speed up things and get the dirty jobs off the americans hands, wouldnt it
