Legal Studies Predictions/Thoughts (5 Viewers)

is the R2P classified as a legal measure? cause ik its part of customary international law + its in the 2005 WS document thing, but i know its not technically like a "legal" response bcs its a responsibility which when breached can lead to legal responses.

what did u guys do for ur case study for HR
in trials i got full marks for talking about the right to asylum even though i didnt really think it fit the question that well which was a 6 marker asking "To what extent do legal measures achieve compliance in the protection of human rights?"

my LCMIDS were
-Migration Act 1958 (cth)
-Migration Amendment Act 2004 (cth) [stated that asylum seekers were allowed to be held in offshore detention centers]
-Australian Human Rights Commission reports in 2004 and 2014 [found human rights abuses in Nauru]
-Migration Amendment Act (2023) [tried to address the lack of adequate shelter and food as found in the reports]

And the main point is that the law reform is responsive to problems while the counterpoint is that it is very inefficient

Probably a lot for 6 marks but also the fact that you only have to practically remember 2 (given that you just have to recall the dates) for an entire contemporary issue is pretty nice.

which judicial process best promotes consistency in sentencing? a) charge negotiations b) statutory guidelines c) guideline judgements d)mandatory minimum sentencing

what would u guys say the right answer is?

we had this question in our trials and like 12% of people got it right lmao, the correct answer is C but most of us picked B and D. Stupid question really because B/C/D are all technically right answers so its kinda hard to pick out the most right one

ik she wants every1 but him to fail i swear + she didnt even teach us abt the right answer option c so i chose d...i had to learn what a literal guideline judgement was by myself
i would say A is the most incorrect answer HELP
cause charge negotiation has nothing to do with consistency in sentencing.
whereas statutory guidelines do, guideline judgements do, and maximum minimum setnencing also somehwat does as well

but overall I would say C (guideline judgements) because it's literally referring to a past case and making a judgement based off of it to ensure consistency

It is, as far as I know. I've used it pretty frequently in past assessments and my trials as a legal response and I've never been told it isn't.

I don't think so tbh the hsc questions are normally a bit clearer but then again NESA just does whatever they want so I wouldn't be surprised if 1-2 multiple choice questions were vague like this to help separate people into diff bands
